1. Acceptance of Terms

By downloading, installing, or using the Orcb mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and the developer of Orcb ("we," "our," or "us").

Please also review our Privacy Policy, which describes how we collect, use, and protect your personal information.

2. Description of the Service

Orcb is a mobile application for cryptocurrency traders that provides:

  • Real-time market capitalization alarms for token pairs on decentralized exchanges (DEX).
  • Token pair search across supported blockchain networks (currently Solana).
  • Push notifications when market cap thresholds are triggered.
  • Live data updates via server-sent events for active alarms.
  • PRO subscription with expanded alarm limits and features.

3. Eligibility

You must be at least 18 years of age to use Orcb. By using the App, you represent and warrant that:

  • You are at least 18 years old.
  • You have the legal capacity to enter into a binding agreement.
  • You are not barred from using the App under applicable law.

4. Account Registration

You may create an account using Apple or Google Sign-In. You are responsible for maintaining the confidentiality of your account credentials and accept responsibility for all activities that occur under your account.

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

5. Free Tier and PRO Subscription

5.1 Free Tier

Orcb is available for free with a limited number of simultaneous active alarms (currently up to 2 alarms), as defined by your plan's alarm limit.

5.2 PRO Subscription

A PRO subscription is available through in-app purchase. Subscriptions are managed by RevenueCat and processed by the Apple App Store or Google Play Store, depending on your device platform.

5.3 Auto-Renewal Terms

Your PRO subscription will automatically renew at the end of each subscription period (monthly or annually, depending on the plan you select) unless you cancel at least 24 hours before the end of the current period.

  • Payment will be charged to your Apple ID account or Google Play account at confirmation of purchase.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price you originally selected.
  • Subscription prices are displayed in the App before purchase and may vary by region. Prices are subject to change, but we will notify you of any price changes in advance, and any increase will not take effect until the next renewal period.

5.4 How to Cancel Your Subscription

You can cancel your subscription at any time. Cancellation takes effect at the end of the current billing period, and you will continue to have access to PRO features until that period ends.

On iOS (Apple):

Open Settings → tap your name → Subscriptions → select Orcb → tap Cancel Subscription. Alternatively, you can manage your subscription through the App by navigating to Profile → Manage Subscription.

On Android (Google Play):

Open Google Play Store → tap your profile icon → Payments & subscriptions → Subscriptions → select Orcb → tap Cancel subscription. Alternatively, you can manage your subscription through the App by navigating to Profile → Manage Subscription.

5.5 Free Trials

If we offer a free trial, you will not be charged during the trial period. At the end of the trial, your subscription will automatically convert to a paid subscription unless you cancel at least 24 hours before the trial ends. Any unused portion of a free trial period will be forfeited when you purchase a subscription.

5.6 Refund Policy

All purchases are non-refundable, except as required by applicable law or as provided by Apple App Store or Google Play Store refund policies. Orcb does not process payments or refunds directly — all billing is handled by the respective app store platform.

6. Account Deletion

You may request deletion of your account and all associated personal data at any time by contacting us at info@orcb.app, or by using the account deletion option available within the App under Profile → Delete Account.

Upon receiving your request, your account and associated personal data will be deleted immediately, and this action cannot be undone. Please note that we may still retain certain information only where we are strictly required to do so for legal, regulatory, or legitimate business purposes (e.g., fraud prevention or compliance with applicable laws).

Deleting your account will immediately terminate your access to the App and all associated services, including any active alarms. Active subscriptions must be cancelled separately through the Apple App Store or Google Play Store to avoid continued billing.

7. Acceptable Use

You agree to use Orcb only for lawful purposes. You agree not to:

  • Attempt to reverse engineer, decompile, or disassemble the App.
  • Scrape, harvest, or collect data from the App by automated means.
  • Use automated bots, scripts, or tools to interact with the App.
  • Create multiple accounts to circumvent subscription or free tier restrictions.
  • Interfere with or disrupt the App's infrastructure, servers, or networks.
  • Use the App in any way that violates applicable local, national, or international law.

We reserve the right to suspend or terminate your account if we determine, in our sole discretion, that you have violated these Terms.

8. Financial Disclaimer — Not Financial Advice

IMPORTANT: Orcb provides market capitalization data and alarms for informational purposes only. Nothing in the App constitutes financial, investment, legal, or tax advice.

Cryptocurrency markets are highly volatile and involve substantial risk of loss, including the potential loss of your entire investment. We are not responsible for any financial losses incurred as a result of using the App or relying on any data, alarms, or information provided by the App.

Market data is sourced from third-party providers (Solana Tracker, DexScreener) and we make no representations or warranties regarding its accuracy, completeness, or timeliness. Data may be delayed, inaccurate, or unavailable at times.

Orcb is not a cryptocurrency exchange, wallet, or financial services provider. The App does not facilitate the buying, selling, or trading of any cryptocurrency or digital asset. You should consult a qualified financial advisor before making any investment decisions.

9. Intellectual Property

The App, including its design, code, logos, trademarks, and content, is owned by the developer of Orcb and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App strictly in accordance with these Terms.

You may not copy, modify, distribute, sell, or lease any part of the App or its content, nor may you reverse engineer or attempt to extract the source code of the App, unless applicable laws prohibit these restrictions or you have our written permission.

10. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy, reliability, or completeness of any data provided through the App, including market capitalization data sourced from third-party providers.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Orcb shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, goodwill, or other intangible losses, or financial losses arising from cryptocurrency trading decisions, arising out of or in connection with:

  • Your use of or inability to use the App.
  • Any inaccuracy, delay, or unavailability of market data or alarms.
  • Unauthorized access to or alteration of your account or data.
  • Any third-party content, services, or conduct.
  • Any other matter relating to the App.

In no event shall our total aggregate liability exceed the amount you have paid us in the twelve (12) months preceding the claim, or $50 USD, whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless the developer of Orcb from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the App.
  • Your violation of these Terms.
  • Your violation of any third-party rights, including intellectual property rights.
  • Any investment or trading decisions you make based on data from the App.

13. Third-Party Services

The App integrates with third-party services including, but not limited to, Firebase Cloud Messaging, Google Sign-In, RevenueCat, Solana Tracker, and DexScreener. Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or content of any third-party services.

Payments for subscriptions are processed by Apple (for iOS) or Google (for Android). By making a purchase, you also agree to the applicable payment processor's terms of service.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date at the top of this page and notify you via push notification or in-app notice at least 30 days before the changes take effect.

Your continued use of the App after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the App and delete your account.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Peru. Any dispute arising out of or relating to these Terms shall be submitted to the competent courts of Lima, Peru.

Nothing in these Terms affects your rights as a consumer under mandatory consumer protection laws of your jurisdiction that cannot be waived or limited by contract.

16. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and the developer of Orcb regarding the use of the App, and supersede all prior agreements, understandings, and communications, whether written or oral.
